Terms of Service

In short:By using RookiePix, you agree to these terms. You must be 18 or older. You're responsible for the photos you upload. We generate cards using AI, and you own the output. Don't upload anything you don't have rights to.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and RookiePix Inc. ("RookiePix," "we," "us," or "our"). By accessing or using the RookiePix platform at rookiepix.com (the "Service"), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 18 years of age to use RookiePix. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

RookiePix is designed for parents, guardians, and coaches to create sports cards featuring youth athletes. If you upload a photo of a minor, you represent that you are the minor's parent, legal guardian, or have obtained explicit consent from the minor's parent or legal guardian to do so.

3. Account Registration

You may use certain features of the Service without creating an account (as an anonymous user). To access additional features — including downloading, modifying, and ordering cards — you must register for an account.

When registering, you agree to provide accurate information and to keep your login credentials secure. You are solely responsible for all activity that occurs under your account. If you become aware of any unauthorized use, contact us immediately at support@rookiepix.com.

4. The Service

RookiePix provides an AI-powered platform that generates custom sports trading cards from user-uploaded photographs. The Service includes:

  • Photo upload and AI-powered quality analysis
  • AI generation of card imagery, player statistics, and biographical content
  • Card customization and modification tools
  • Digital card download
  • Physical card ordering (when available)

The Service relies on third-party AI models and cloud infrastructure. We do not guarantee uninterrupted availability, specific output quality, or that generated content will meet your expectations. AI-generated outputs may vary between generations.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You may upload only photos that you have the legal right to use.

Permitted Use

  • Creating sports cards for yourself, your children, or athletes with their (or their guardian's) consent.
  • Downloading and sharing your generated cards for personal, non-commercial use.
  • Ordering physical prints of your generated cards.

6. Prohibited Content & Conduct

You must not upload, generate, or use the Service to create content that:

  • Infringes intellectual property: Photos of celebrities, professional athletes, or other public figures without their express permission.
  • Lacks authorization for minors: Photos of children without consent from a parent or legal guardian.
  • Deceives or impersonates: Content intended to mislead others about a person's identity, including "deepfake"-style misuse of the platform to create fake identification or credentials.
  • Is harmful or offensive: Content that is defamatory, threatening, harassing, hateful, discriminatory, sexually explicit, or promotes violence.
  • Violates any law: Content that violates any applicable local, national, or international law or regulation.
  • Exploits minors: Any content that exploits, harms, or endangers children in any way.

RookiePix reserves the right to remove any content and suspend or terminate any account that violates these prohibitions, without prior notice and at our sole discretion.

7. Content Ownership & Licensing

a) Your Uploaded Content

You retain all rights to the photos you upload. By uploading a photo to RookiePix, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and temporarily store the photo solely for the purpose of providing the card generation service. This license terminates when the photo is deleted pursuant to our data retention policy.

We do not use your uploaded photos for AI model training, marketing, advertising, or any purpose beyond delivering the Service to you.

b) AI-Generated Output

To the extent permitted by applicable law, RookiePix assigns all right, title, and interest in the AI-generated card output to you. You are free to use, share, print, and display your generated cards without restriction from RookiePix.

Important note on AI-generated works: Courts and intellectual property offices in the United States, Canada, and other jurisdictions have indicated that works generated solely by artificial intelligence may not be eligible for copyright protection. This means that while RookiePix assigns its interest in the generated cards to you, the enforceability of copyright in AI-generated works remains uncertain and may vary by jurisdiction.

c) RookiePix Platform

All intellectual property in the RookiePix platform — including its design, code, branding, logos, UI components, and proprietary AI integration — remains the exclusive property of RookiePix Inc. These Terms do not transfer any platform IP to you.

8. Biometric Data Consent

Before uploading any photo, you must provide explicit consent for our AI to process facial features in the image. This consent is collected through a mandatory consent prompt. You may withdraw consent at any time by discontinuing use of the Service or deleting your account. For details on how we handle biometric data, see our Privacy Policy.

9. Copyright Infringement & DMCA

RookiePix respects the intellectual property rights of others. If you believe that content on our platform infringes your copyright, please submit a takedown notice in accordance with our DMCA Policy.

We will respond to valid notices of infringement and may remove content and/or terminate accounts of repeat infringers in accordance with the Digital Millennium Copyright Act and applicable Canadian copyright law.

10. Indemnification

You agree to indemnify, defend, and hold harmless RookiePix Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Service;
  • Content you upload or generate through the Service;
  • Your violation of these Terms;
  • Your violation of any rights of a third party, including intellectual property, privacy, or publicity rights;
  • Any claim that content you uploaded or generated caused damage to a third party.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ROOKIEPIX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR MEET YOUR EXPECTATIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROOKIEPIX INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL ROOKIEPIX'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO ROOKIEPIX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

13. Content Moderation & Removal

RookiePix reserves the right, but has no obligation, to monitor, review, or remove any content uploaded to or generated through the Service. We may remove content and suspend or terminate accounts at our sole discretion, including in response to DMCA takedown notices, reports of prohibited content, or violations of these Terms.

14. Account Termination

By you: You may delete your account at any time. Upon deletion, we will remove your account data, uploads, and generated content in accordance with our Privacy Policy.

By us: We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including for violations of these Terms or conduct that we determine, in our sole discretion, is harmful to the platform, other users, or third parties.

15. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will provide at least 30 days' noticeby posting the updated Terms on the platform with a revised "Last updated" date and, where practicable, notifying you through the Service. Your continued use of the Service after the notice period constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and DMCA Policy, constitute the entire agreement between you and RookiePix regarding your use of the Service and supersede all prior agreements and understandings.
