Digital Millennium Copyright Act — Notice and Takedown Procedure

Respect for Intellectual Property

RookiePix Inc. ("RookiePix") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA") and applicable Canadian copyright law, we will respond promptly to valid notices of alleged copyright infringement that are reported to our Designated Agent.

How to Submit a Takedown Notice

If you believe that content on RookiePix infringes your copyright, please send a written notification to our Designated Agent containing all of the following elements, as required by 17 U.S.C. § 512(c)(3):

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list.
  2. Identification of the infringing material: Identify the material on RookiePix that you claim is infringing, with sufficient detail for us to locate it. Please include the URL(s) or other specific identifying information (e.g., card generation ID, screenshot with URL visible).
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Warning:Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

What Happens After We Receive a Valid Notice

Upon receipt of a valid DMCA takedown notice, we will:

  1. Promptly remove or disable access to the allegedly infringing material.
  2. Notify the user who uploaded or generated the content that the material has been removed.
  3. Provide the user with a copy of the takedown notice and information about how to submit a counter-notification.

Counter-Notification

If you believe that material you uploaded or generated was removed in error or is not infringing, you may submit a counter-notification to our Designated Agent containing all of the following:

  1. Identification of removed material: Identification of the material that was removed and the location where it appeared before removal.
  2. Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, the judicial district in which RookiePix is located), and that you will accept service of process from the person who provided the original takedown notice.
  4. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  5. Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and inform them that the removed material may be restored in 10–14 business days unless the complainant notifies us that they have filed a court action seeking to restrain the user from engaging in the infringing activity.

Repeat Infringer Policy

In accordance with the DMCA, RookiePix maintains a policy of terminating the accounts of users who are determined to be repeat infringers in appropriate circumstances. If a user receives multiple valid DMCA takedown notices, we may, at our sole discretion, disable or terminate their account permanently.

Canadian Copyright Act

For notices under the Canadian Copyright Act (notice-and-notice regime), rights holders may send notices to our Designated Agent using the same contact information above. We will forward the notice to the relevant user in accordance with Canadian law. Please note that the Canadian regime does not require automatic takedown; however, we will review each notice and may remove content that violates our Terms of Service.
